Acceptable Use Policy

  • Scraping, harvesting, or collecting data from the Service using automated tools (except as explicitly provided by the Service's features)
  • Reselling, redistributing, or sharing lead data obtained through the Service with third parties in violation of our Terms
  • Using lead data in ways that violate data protection laws (GDPR, CCPA, etc.)
  • Creating databases or compilations of lead data for resale or competitive purposes
  • Using competitor intelligence features to harm or defame businesses

2.4 System Abuse and Security

  • Attempting to gain unauthorized access to the Service, user accounts, or systems
  • Introducing viruses, malware, or other malicious code
  • Conducting security testing or vulnerability scanning without prior written authorization
  • Overloading or disrupting the Service infrastructure (denial of service attacks)
  • Circumventing rate limits, usage restrictions, or authentication mechanisms
  • Reverse engineering, decompiling, or attempting to extract source code

2.5 Misrepresentation and Deception

  • Impersonating another person, organization, or LeadScoutr employee
  • Creating fake or misleading accounts
  • Providing false information during registration
  • Misrepresenting your affiliation with any person or organization

2.6 Intellectual Property Violations

  • Infringing on copyrights, trademarks, patents, or other intellectual property rights
  • Using the Service to distribute pirated or unauthorized content
  • Violating our intellectual property rights or those of other users

2.7 Unfair or Abusive Practices

  • Using the Service to monitor or scrape competitors' data with the intent to harm their business
  • Creating multiple accounts to circumvent usage limits or free trial restrictions
  • Sharing account credentials with unauthorized users
  • Using the Service in a way that harms other users or the platform

3. Fair Usage and Rate Limits

3.1 Usage Limits

To ensure fair access and maintain Service quality for all users, we implement usage limits based on your subscription plan. Excessive usage that impacts Service availability for others may result in rate limiting or account suspension.

3.2 Automated Access

Automated or scripted access to the Service (beyond what is provided through official API endpoints, if any) is prohibited without prior written authorization. This includes:

  • Bot accounts or automated scraping tools
  • Excessive API calls or requests
  • Attempts to bypass rate limiting mechanisms

3.3 Resource Consumption

You may not use the Service in a way that excessively consumes computational resources, storage, or bandwidth, or that degrades the experience for other users.

4. Content Standards

When using the Service, you must not upload, post, or transmit content that:

  • Is illegal, harmful, threatening, abusive, or discriminatory
  • Violates any person's privacy or publicity rights
  • Contains hate speech or promotes violence
  • Is sexually explicit or pornographic (unless relevant to legitimate business context)
  • Contains confidential or proprietary information without authorization

5. Compliance with Laws

You are responsible for ensuring your use of the Service complies with all applicable laws and regulations, including but not limited to:

  • Data Protection Laws: GDPR (EU), CCPA (California), and other privacy regulations
  • Anti-Spam Laws: CAN-SPAM Act (US), CASL (Canada), and similar regulations
  • Telemarketing Laws: TCPA (US) and do-not-call regulations

It is your responsibility to obtain proper consent and comply with applicable laws when contacting leads obtained through the Service.

6. Consequences of Violation

6.1 Enforcement Actions

If we determine that you have violated this AUP, our Terms of Service, or applicable laws, we may take any of the following actions:

  • Issue a warning and request corrective action
  • Temporarily suspend your account or specific features
  • Permanently terminate your account without refund
  • Remove or delete violating content
  • Restrict access to certain features or data
  • Report violations to law enforcement or regulatory authorities
  • Take legal action to recover damages

6.2 Investigation

We reserve the right to investigate suspected violations of this AUP. During an investigation, we may suspend your account and access to the Service.

6.3 No Refunds

Accounts suspended or terminated for AUP violations are not eligible for refunds of subscription fees.
